A Winnipeg building firm says it shouldn’t have to fix alleged defects on a condo building because of a multi-year inspection backlog at the city.

The city is ordering A & S Construction to repair a number of problems with 56 units of a condo complex in Richmond West.

Documents say, in many cases, requirements for insulation have not been met, material used to vent dryers is incorrect, and access doors to attics have not been weather stripped.

But A & S says it asked the city six years ago to do a final inspection on the project and no one showed up for years.

The construction firm has hired lawyers from Tapper Cuddy to fight the orders.

“It is completely inequitable and unfair that A&S followed the proper procedure on the project but, due to a significant backlog at the city, the final inspections did not, apparently, occur until February 2015, four to six years after completion of the project and possession by the owners of the units in it,” writes Jason Harvey from Tapper Cuddy.

The company is appealing the orders at a hearing Friday morning at city hall.
