The legal challenge against Winnipeg's growth fees could happen early in the new year.

Mike Moore from the Manitoba Homebuilders Association said the goal right now is to file it in court next month.

The industry has been critical of the new charge on new homes in emerging suburbs arguing the city can't move forward without provincial approval.

But the mayor and others at city hall believe otherwise. Brian Bowman says the new fees are necessary to pay for infrastructure related to growth in sprawling neighbourhoods.

For now, downtown and infill housing projects are exempt from the new charge.
