Ottawa is appealing a decision that would force the federal government to consult with a group of First Nations over the future of the Kapyong Barracks property in Winnipeg.

In December, a federal court ruled in favour of the First Nations, who want to develop the former military base in South Winnipeg.

Ottawais appealing the ruling, saying the judge made errors in law, with respect to his analysis on the duty to consult.

Prior to the court decision, CTV learned both sides were closing in on a deal over the future of Kapyong.
