A Winnipeg firefighter accused of stealing from a patient, who later died, had his first court date Tuesday.

Darren Fedyck, 46, is charged with one count of theft under $5,000. Court records allege he stole money and jewelry from a 76-year-old woman on Oct. 2, 2015.

Last month, police confirmed the incident is work related; CTV is told he is suspended without pay.

Fedyck did not appear in court on Tuesday, and the case has been put over to Feb. 24.

This isn't the first time the firefighter has been accused of wrongdoing where jewelry was involved.

In 2010, Fedyck pled guilty to fraud under $5,000 in relation to insurance claims over an engagement ring and wedding bands worth $2,000.

Two years earlier, Fedyck reported a break in at his house. He claimed several items were stolen, including the rings, and  was paid $27,000 by Wawanesa Insurance.

Court documents show a relative told police the jewelry was never stolen, and that Fedyck still had it in his possession.

The firefighter received a conditional discharge and emailed an apology to Wawanesa:

"I am writing to your company to formally apologigize for adding an additional item to my break-in claim. At the time, I was going through a marriage breakdown and I made a bad judgment call. I feel deep remorse for my actions."

Wawanesa sued Fedyck for the remaining $25,000 worth of goods.

In that case, Fedyck denied he defrauded Wawanesa; claiming he didn't know where the ring was when the break-in occurred and believed it was missing.

That case was discontinued in 2013.
