Closing arguments were heard on Tuesday in the trial of Thomas Brine.

The Winnipeg man is accused of sexually assaulting and killing 73-year-old Elizabeth Lafantaisie.              

Crown attorney Brian Bell urged the jury of nine men and three women to find Brine guilty.

Bell said the evidence against Brine is "straightforward...and frankly, there's lots of it."

Elizabeth Lafantaisie's body was found in the trunk of her car on Feb. 24, 2011; she'd been sexually assaulted.

"The sexual assault and murder happened so close, it was a continuous act," said Bell.

The Crown detailed forensic evidence for the jury, saying there was just a one-in-68-trillion per cent chance the DNA profile belongs to someone other than Brine.

Bell also detailed the lengths he says Brine went through to conceal his involvement in the case, including washing the car before it was abandoned.

"Why did this crime happen? We'll never know," said Bell. "We do know who did it...this accused, Thomas Brine."

Defence lawyer Bruce Bonney argued the case isn't so straightforward; he said while Brine steals cars, he isn't guilty of murder.

Bonney criticized the way DNA evidence was labelled and tested, arguing it was "careless and negligent."

He told the jury they "can't be satisfied with swabs and where they came from." 

Bonney says it's possible there was a transfer of DNA when Brine reached around in the trunk of the car.  

"We could be dealing with a mislabelled exhibit. Maybe (Brine) touched some other part of Ms. Lafantaisie," said Bonney.

Bonney also asked the jury why Brine only washed the car.

"If he had raped and murdered her, wouldn't he have done something more to the body to hide his tracks?" the defence lawyer asked.

"He didn't know his DNA was there, because he didn't do anything," said Bonney.

He then asked the jury to consider, "Is the real killer out there? This has to trouble you." 

Then saying there is reasonable doubt, Bonney asked the jury to find Brine not guilty.

The judge will instruct the jury on Wednesday; after that, Thomas Brine's future will be in their hands.
