A Manitoba judge's decision to reject the federal government's mandatory minimum sentence for gun crimes is being appealed by the Crown.

An appeal notice has been filed in the case of Bryce McMillan, who was sentenced earlier this month to one year in jail.

The mandatory minimum is four years, but Justice John Menzies of Brandon Court of Queen's Bench ruled that the term would be excessive and harsh.

McMillan, who is from Carberry, pleaded guilty to firing a gun in September 2011 at the home of a person he said had been tormenting him.
