A Winnipeg family is suing Festival du Voyageur after their daughter was seriously injured at the park in 2014.

Court documents filed earlier this month, show the daughter of Lynne and Raymond Comeault was hurt on a slide run by Festival du Voyageur on Feb. 20, 2014.

The law suit states the slide was “designed for participants, including children, to race down an ice covered track at high rates of speed.”

It says the slide didn’t require any form of restraints or safety gear, and operated with “little or no supervision.”

Now the family is suing the park for damages and costs after their daughter, age 12 at the time, was ejected from her sled, and propelled into the air.

Court documents show she hit her head and tailbone on an ice path, resulting in extensive injuries including a concussion, misaligned eyes, a brain injury, as well as depression and anxiety.

The lawsuit states the girl missed the remainder of her grade seven year at school, and had minimal participation in her grade eight and nine years.

The family is looking for compensation from the park for a long list of damages including the daughter’s pain and suffering due to long-term injuries, the family’s emotional and mental distress, as well as cost of medical care, and a loss of income for the parents.

The lawsuit states the accident was caused by the park’s negligence to:

Adequately supervise and monitor patrons using the slide

- Maintain and inspect the slide in a safe condition

- Require safety equipment for the patrons.

- The family’s lawyer didn’t provide a comment on the lawsuit.

Officials at Festival du Voyageur said they are unable to comment on the incident as court proceedings are currently pending.

There was no dollar amount specified in court documents.

Allegations have not been proven in court.
